Confidentiality Policy

The Analytical Expert Labs policy is set out below.

Analytical Expert Labs have a duty to ensure the protection of its customers’ confidential information/data and proprietary rights, including the protection of the electronic storage and transmission of information to a customer. This requirement covers past and present work carried out for a customer.

PROCEDURE

Examples of the Confidentiality Requirements.

  1. Analytical Expert Labs are responsible, through legally enforceable commitments, such as a Contract(s) with a customer, for the management of all information obtained or created during the time that activities are carried on behalf of that customer.
  2. Analytical Expert Labs will inform the customer, along with its reasoning, in advance, about any information that it intends to place in the public domain.
  3. All other information, apart from that described in 2, see above, is to be considered proprietary and is to be treated as confidential.
  4. When Analytical Expert Labs is required by law or a through contractual commitment to release confidential information, the customer will be notified about the information requested unless the customer is prohibited by law from being made aware of this action.
  5. Information about the customer, obtained from sources other than the customer, such as a complainant, or a Regulator is to be confidential between the customer and the laboratory. Taking into consideration GDPR regulation 2018.
  6. All personnel acting on behalf of Analytical Expert Labs, such as Laboratory staff, Contractors, Suppliers and staff of external bodies, e.g. Accreditation Bodies and Regulators will keep all information obtained or created during the laboratory’s testing activities confidential, except as required by law.

Any member of staff, permanent, temporary or working via an agency having a concern about any aspect of confidentiality, should discuss it with their manager, at the earliest opportunity.
